Terms of Service
These terms are an agreement between you and Pocket Nexus, Inc., a Delaware C corporation, which operates Pocket Studio at studio.pocket.nexus and the game addresses under it. Using Pocket Studio means you agree to them. If you do not agree, do not use it.
Your account
You can look around as a guest. To keep a room, publish a game under your name or become a member you need an account, which you make by signing in with a code sent to your email address, with Google or with GitHub.
- You must be at least 13 years old. If you are not old enough where you live to agree to these terms yourself, a parent or guardian must agree to them for you and to any purchase.
- An account is for one person. Keep your email and your sign-in secure. You are responsible for what is done with your account, except for what is done after you told us someone else has access to it, and for what a failure of ours caused.
- The handle you choose is shown with the games you publish. Do not choose one that pretends to be someone else.
The membership
The membership is optional. Its price, how often it is billed and any tax on it are shown before you pay, and that is what you are charged. Prices can differ between countries and currencies, and they can change. An offer or a discount follows the conditions shown with it.
- The membership is sold through Link, a service of Stripe, our payment provider, which is the merchant of record for the sale: it takes the payment, works out and collects any sales tax, VAT or GST that applies where you are, and sends you the receipt. Your card statement shows LINK.COM followed by our name. Link does not sell to buyers in mainland China: there we sell the membership ourselves, Stripe takes the payment for us, and your card statement shows our name. In a few other countries Link does not sell and the membership cannot be bought. We do not receive or store your card number.
- A membership renews for the same period at the end of each period, at the price you bought it for, and you are charged again, until you cancel.
- If the price of your membership is going to change, we tell you in the Studio or by email at least 30 days before your first renewal at the new price. You can cancel before then, and the membership lasts to the end of the period you paid for.
- You can cancel at any time under Manage membership in your account menu. After you cancel, the membership lasts to the end of the period you paid for and does not renew.
- When a membership ends, the projects you published and their links stay. Games of yours that your membership alone put on Pocket TV and in search leave both, your devices return to the free colours, and packages you downloaded stay with you.
- A payment is not refunded, except where the law requires a refund, where these terms promise one, or where we choose to. Outside mainland China, Link can also refund a payment under its own policy.
- If you believe a payment was taken in error, write to support@pocket.nexus.
What the membership includes is described where it is offered and may grow or change. If a change takes away something you paid for during a paid period, we refund the part of that period it affects when you ask.
We may also give a membership through an offer we make to certain people, such as a membership for life to those who sponsored our founder on GitHub, or a membership for a time to the winners of a draw. The offer says what it gives and how it is claimed. A membership given this way is free of charge, belongs to the account that claimed it, and cannot be transferred or exchanged for money. It ends when its time ends or when the account is deleted, and it can be withdrawn if it was claimed against the offer's rules.
What you publish
You can publish games and other projects you made, and upload packages of them for real devices. What you publish stays yours.
- By publishing something you give Pocket Nexus a licence, free of charge and for as long as it is published, to host it, to show it and its cover in the Studio, on its own address, on Pocket TV, in search and on the shelves of the people who keep it, to show its name, its cover and pictures of it in Pocket Nexus's own pages and posts about Pocket Studio, to make its packages available for download to members when you switch downloads on, to make packages of a game you build in Pocket Studio for the devices it has builds for, and to give a copy of a game's source to the people who remix it.
- A game you make with the Pocket Studio command line carries its source files: each build sends them to us, and we keep the newest. While the game is published, anyone with a Pocket Studio account may remix it: start a game of their own from a copy of its source, change it and publish the result under these terms. By publishing a game you give every Pocket Studio user a licence, free of charge, to copy, change and publish its source in that way. A remix names the game it came from.
- You may only publish what you have the right to publish, including its code, pictures, sound and names.
- You can take a project down or delete it at any time. That ends the licence from then on and stops new remixes. Copies that members downloaded before, and remixes made before, stay with the people who have them.
- An account may hold 50 projects and 3 GiB of stored files. These limits may change.
Packages are homebrew
A package is a file built for a device such as a PSP, a PS Vita, a Nintendo 3DS, an iPod touch or an Android phone. Packages of other people's games are homebrew: either the author uploaded the package, or Pocket Studio made it from the author's game with Pocket Nexus's runtime for that device, and in both cases Pocket Nexus has not tested the game in it. Pocket Studio signs every Android package it makes with one key Pocket Nexus keeps for games made in Pocket Studio, which is not the key of Pocket Nexus's own apps. A project marked as verified was published or reviewed by Pocket Nexus; the mark says who stands behind the project and is not a promise about how a package behaves on your device.
- You install a package on your own device at your own risk. Whether your device can run it, and what it takes to make your device run software of this kind, is yours to find out and to decide.
- Do not install a package on a device without its owner's permission.
What is not allowed
- Publishing software meant to harm a device, its data or its owner, or that does something the person running it was not told about.
- Publishing what you do not have the right to publish, or what is unlawful where you live or in the United States.
- Publishing material that sexualises minors, that threatens or harasses a person, or that exposes someone's private information.
- Interfering with Pocket Studio, getting around its limits, reading other people's data, or using it to attack anything else.
- Making accounts by automated means, or using someone else's account.
We may take down a project, remove a package or close an account that breaks these terms. We tell you what we did and why, and you can write to us if you think we are wrong. We may act without notice where waiting would cause harm or where the law does not allow us to say.
Reporting a game, and takedown requests
To report a game or a package, write to support@pocket.nexus with its address and what is wrong with it.
If you believe something published here infringes your copyright, send the same address a notice that identifies the work you own, the address of the material here, your contact details, a statement that you believe in good faith the use is not authorised, a statement that your notice is accurate and that you are the owner or act for the owner, and your signature. We review notices and remove material where the notice is in order. The person who published it may answer with a counter-notice.
Names of devices and other companies
PlayStation, PSP and PS Vita are trademarks of Sony Interactive Entertainment Inc. Nintendo 3DS is a trademark of Nintendo. iPod touch is a trademark of Apple Inc. Android is a trademark of Google LLC. Pocket Studio uses these names to say which devices a game runs on. Pocket Nexus is not affiliated with, sponsored by or endorsed by any of them.
The service as it is
Pocket Studio is provided as it is and as it is available. It changes often, parts of it may be removed, and it may be unavailable at times. To the extent the law allows, Pocket Nexus gives no warranty of any kind, including that the service or any game or package on it is fit for a particular purpose, free of errors or safe for your device.
To the extent the law allows, Pocket Nexus is not liable for indirect, incidental or consequential loss, for lost data or for damage to a device, and its total liability to you for any claim about the service is limited to the greater of the amount you paid for the membership in the twelve months before the claim and USD 50.
These limits do not apply to loss caused by our intent or gross negligence, or to death or personal injury caused by our negligence. If you are a consumer in Japan, they apply only where our negligence was slight. Nothing in these terms limits a right you have under the law that cannot be limited by agreement.
Ending
You can stop using Pocket Studio at any time. To have your account and what it holds deleted, write to support@pocket.nexus from the email address of the account, and we delete it. We may suspend or close an account that breaks these terms. If we close your account for another reason, or stop running Pocket Studio, we tell you at least 30 days before where we can, and we refund the unused part of a paid period. Sections that by their sense should outlast the end of your account, such as the licence for copies already downloaded and the limits of liability, do.
Law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. A dispute about them or about Pocket Studio is heard in the state and federal courts located in Delaware, unless the law where you live gives you the right to bring it elsewhere.
Changes to these terms
We may change these terms. When a change takes away a right you have, adds an obligation or a charge, or otherwise works against you in a significant way, we tell you in the Studio or by email at least 30 days before it takes effect, and the room asks you once to accept it. Other changes, such as clarifications, new features and changes in your favour, take effect when the new text is posted here with its date. A change of price follows the membership section above, and an offer follows its own conditions.
If you do not agree to a change, you can stop using Pocket Studio, cancel your membership and ask for your account to be deleted.
